A criticism which is made in good faith [on] an order or ruling [in any legal] case and does not employ a language or contain a meaning [that is] rude, satirical, or malicious does not constitute an offence of contempt of court.

Mr Piyabut stated also that, principally, the term "contempt of court"...[refers to the event in which] the court is sitting on the bench [for] trying a case and there happens to be an act of obstructing the trial, there takes place an act of blocking the court, [or] there is an act of causing unrest or contravening a court order. Things like these are considered to be acts of contempt of court, and there is nothing to do with an act of commenting or criticising [court decision]. So, criticism on rulings of the Constitutional Court, even made in bad faith [or in a] rude [or] satirical [manner], is not deemed to be an act of contempt of court.

“มาตรา ๓๓ ถ้าคู่ความฝ่ายใดหรือบุคคลใดกระทำความผิดฐานละเมิดอำนาจศาลใด ให้ศาลนั้นมีอำนาจสั่งลงโทษ...(ก) ไล่ออกจากบริเวณศาล หรือ (ข) ให้ลงโทษจำคุก หรือปรับ หรือทั้งจำทั้งปรับ”

Section 33 Should any party or any person commit an offence of contempt of any court, such court shall have the power to order the infliction of [this] penalty [upon that party or person]:...(a) ejecting [him] out of the court precincts or (b) ordering the infliction of [a term of] imprisonment or a fine or both the imprisonment [term] and the fine.
