Section 219 ter In the case where the court of first instance imposed the penalty of confinement in lieu of the penalty of imprisonment or changed the penalty of confinement to the penalty of imprisonment, or the case which concerns confinement in lieu of fine or confinement in relation to the confiscation of property, if the appellate court did not give a judgment reversing the judgment of the court of first instance, the parties are prohibited from lodging a final appeal on a question of fact.
