Section 161 If the fraud is merely a cause by which a party is moved to accept a requirement which is heavier than that which the party would normally accept, the party cannot avoid his act but is entitled to claim compensation for the damage arising from such fraud.

The parties have performed two overlapping juristic acts: one called hiding juristic act, the other called hidden juristic act. The hiding juristic act has been done by the parties in an open manner...[despite] the fact that the parties did not want [any] binding or effective result [therefrom]... [This act was for] concealing or hiding the other juristic act, which is the juristic act the parties wished to be bound by actually.

(Although) the juristic act of hire-purchase is a juristic act between the Plaintiff and the Defendant and the juristic act of loan is a juristic act between A and the Defendant, it could be deemed that the parties to the two juristic acts are the same parties. The juristic act of hire-purchase is thus considered a juristic act that hides the loan and becomes void in accordance with CCC, § 155, ¶ 1.
