คำนิยาม

ทรัพย์สินที่ฝ่ายชายได้ส่งมอบหรือโอนให้แก่หญิง เพื่อเป็นหลักฐานว่าจะสมรสกับหญิงนั้น

ตัวอย่าง

“มาตรา ๓ ให้ยกเลิกความในมาตรา ๑๔๓๖ และมาตรา ๑๔๓๗ แห่งประมวลกฎหมายแพ่งและพาณิชย์ และให้ใช้ความต่อไปนี้แทน "...มาตรา ๑๔๓๗ การหมั้นจะสมบูรณ์เมื่อฝ่ายชายได้ส่งมอบหรือโอนทรัพย์สินอันเป็นของหมั้นให้แก่หญิงเพื่อเป็นหลักฐานว่า จะสมรสกับหญิงนั้น เมื่อหมั้นแล้ว ให้ของหมั้นตกเป็นสิทธิแก่หญิง...ถ้าจะต้องคืนของหมั้นหรือสินสอดตามหมวดนี้ ให้นำบทบัญญัติมาตรา ๔๑๒ ถึงมาตรา ๔๑๘ แห่งประมวลกฎหมายนี้ ว่าด้วยลาภมิควรได้ มาใช้บังคับโดยอนุโลม"”

Section 3 The provisions of Section 1436 and Section 1437 of the Civil and Commercial Code shall be repealed and replaced by the following: "...Section 1437 An engagement shall be complete when the man side has delivered or transferred the property which is the engagement gift to the woman as evidence that the man will marry the woman. Upon engagement, the engagement gift shall absolutely belong to the woman... Should an engagement gift or bride price need to be returned under this Chapter, the provisions of Section 412 to Section 418 of this Code, which govern unjust enrichment, shall apply mutatis mutandis."
