คำนิยาม

การใช้อุบายหลอกลวงด้วยการแสดงข้อความอันเป็นเท็จ หรือการจงใจปิดบังซ่อนเร้นข้อความจริงเพื่อให้ผู้อื่นหลงผิดจนเข้าทำนิติกรรม หรือจนคู่กรณีอีกฝ่ายหนึ่งยอมรับข้อกำหนดอันเป็นภาระอันหนักขึ้นกว่าที่คู่กรณีฝ่ายนั้นจะยอมรับโดยปรกติ

Section 163 If both parties have performed their acts by [exercising] frauds against each other, neither of them may assert the other's fraud to avoid his own act or claim compensation.
